These terms are an agreement between you and Jon Olson ("we", "us"), who makes RoadTripKit. They cover the RoadTripKit app for iPhone and iPad, the web app and this website. By using RoadTripKit you agree to them. If you set up a car for your family, you agree on behalf of the children who play in it.
Safety comes first
The driver must never use RoadTripKit while driving. Mark the driver's phone in the app so its games lock while the car is moving, don't switch that off while driving, and let a passenger run grown-up mode. Games that ask players to look out the window are for passengers only. You're responsible for following the law and driving safely; RoadTripKit is never a reason to take your attention off the road.
Your family's car
- A car must be set up by an adult (a parent, guardian or other grown-up responsible for the children in it). That adult is responsible for who joins the car and what goes in it.
- Anyone with your car code or invite link can join your car, so share it only with people you'd hand a phone to in the back seat. You can replace the code at any time.
- Kid and parent codes keep players out of each other's points. They aren't passwords and don't protect sensitive information, so don't put any in the app.
- You can delete your car at any time from Family & devices.
What you put in
Names, fun facts, game answers and anything else you enter stay yours. You give us permission to store, sync and process it only to run RoadTripKit for your car, including, in the iPhone and iPad app, sending some of it to our AI provider as described in the privacy policy. Please don't enter anything unlawful, hateful, or anything you don't have the right to share.
AI-written content
In the iPhone and iPad app, some trivia questions, Mad Libs, hot-seat questions and story chapters are written by an AI model. They're instructed to be kind, accurate and right for each player's age, but AI can make mistakes, including wrong answers to trivia. Treat them as a game. If you see something inappropriate, tell us at roadtripkit@springmillai.com.
Fair use
Don't try to access other families' cars, guess car codes, overload or attack our servers, use automated tools against the service, or use RoadTripKit to build a competing service. We may limit or end access for anyone who does.
Our stuff
RoadTripKit, its games, design, artwork and code belong to us or our licensors. We grant you a personal, non-transferable license to use RoadTripKit for your family's own fun. Fonts are used under the SIL Open Font License.
Changes and availability
We may add, change or remove games and features, and we may update these terms. If a change is significant, we'll give notice on this site and in the app's update notes before it takes effect. RoadTripKit depends on internet services and may sometimes be unavailable; games that work offline keep working when it is.
No warranty
RoadTripKit is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We don't promise it will be error-free, uninterrupted, or that AI-written content will be accurate.
Limit of liability
To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for lost data, arising from your use of RoadTripKit. Our total liability for any claim is limited to the greater of the amount you paid us for RoadTripKit in the past 12 months, or US$10. Some places don't allow these limits, so they may not apply to you, and nothing here limits rights you have under consumer protection law.
If you got the app from the App Store
Apple's Licensed Application End User License Agreement also applies to the iOS app. Where it and these terms differ for the iOS app, Apple's agreement wins. In addition:
- These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to meet any applicable warranty, you can notify Apple for a refund of its purchase price, if any. Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims.
- You confirm that you're not in a country subject to a US government embargo or on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
